Our client, a highly regarded specialist law firm recognised by both Legal 500 and Chambers and Partners, is seeking an experienced Court of Protection Solicitor to join its team in London.
This is an excellent opportunity for a senior practitioner to work within a market-leading department, handling complex and meaningful work while contributing to the development of both the team and the wider firm. The role offers long-term career progression, including the opportunity to move towards team leadership, supervise junior colleagues, and develop a recognised niche practice.
The Role
- Manage Mental Capacity Welfare cases in the Court of Protection from instruction to conclusion.
- Advise clients on health and welfare decisions, best interests, deprivation of liberty and related issues.
- Conduct Community Care and Judicial Review matters linked to mental capacity issues.
- Provide pragmatic, legally robust advice to vulnerable clients and their representatives.
- Draft pleadings, statements, and legal submissions.
- Liaise with the Official Solicitor, local authorities, healthcare providers, and other professionals.
- Maintain files and case management in line with Lexcel and firm procedures.
- Ensure compliance with SRA standards, Legal Aid Agency regulations, and internal policies.
- Assist with supervision, mentoring, and technical guidance of junior team members.
Skills and Experience
- Qualified Solicitor or FILEX with at least 6 years' PQE in Mental Capacity law.
- Strong experience handling Health and Welfare cases in the Court of Protection.
- Excellent working knowledge of Mental Capacity Law and Practice.
- Good working knowledge of Mental Health Law, Community Care law, and Judicial Review.
- Experience working with legally aided matters and familiarity with LAA requirements.
- Member of the Law Society Mental Capacity (Welfare) Accreditation Scheme, or working towards accreditation.
- Confident communicator with excellent client care skills.
- Ability to manage complex cases and competing court deadlines effectively.
